1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Nailumi, operated by 9VIL LLC ("9VIL", "we", "us", or "our"), a United States limited liability company operating under the 9VIL brand.

By downloading, accessing, purchasing through, or using Nailumi, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Nailumi.

2. Nailumi Service

Nailumi is an AI-powered nail visualization service that lets you choose a nail design and a hand image, generate a nail try-on preview, and save, share, or revisit results.

Nailumi is intended for personal, non-commercial visualization and inspiration. It is not a professional beauty, medical, dermatological, or salon service.

4. AI-Generated Results

Nailumi previews are generated using AI. Results may be incomplete, inaccurate, unrealistic, or contain visual artifacts. A preview is an artistic visualization and may not exactly match how a design will look when physically applied.

You are responsible for reviewing a preview before relying on, saving, sharing, or attempting to reproduce it. We do not guarantee a particular appearance, salon outcome, compatibility with a real nail shape, or suitability of any cosmetic product or procedure.

5. Accounts, Sessions, and History

Nailumi may create an app account or session automatically without requiring registration. This session can hold History, credits, and related service data.

Because access may depend on the current app session or device credentials, uninstalling the app, clearing app data, losing credentials, or changing devices may affect your ability to recover History or credits. Do not rely on Nailumi as the only storage location for images you wish to keep.

6. Credits and Purchases

Nailumi may provide complimentary credits and offer additional generation credits for purchase. Current offers, prices, included credit amounts, taxes, and any applicable conditions are displayed in the app at the time of purchase and may change.

Payments are processed through the Apple App Store or Google Play under the terms of the applicable store. 9VIL LLC does not directly collect your full payment-card details. Refunds, cancellations, purchase authorization, and payment disputes are subject to the applicable store's policies and your rights under applicable law.

Credits are limited, revocable licenses to access eligible Nailumi functionality. They have no cash value, are not legal tender, cannot be transferred or resold, and cannot be redeemed for cash except where required by law. Credits do not guarantee that a requested generation will produce a particular result.

7. Acceptable Use

You agree not to misuse Nailumi, interfere with service operation, bypass credit or security controls, automate access without authorization, reverse engineer the service where prohibited, introduce malicious code, impersonate another person, or use Nailumi for unlawful, deceptive, abusive, or harmful purposes.

You may not use generated results or Nailumi branding in a manner that violates law, misrepresents an affiliation with 9VIL LLC, or infringes the rights of others.

8. Nailumi Intellectual Property

Nailumi, its software, visual design, branding, text, service-generated interfaces, and related materials are owned by or licensed to 9VIL LLC and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of Nailumi or its underlying technology to you.

9. Service Availability and Termination

We may update, modify, suspend, limit, or discontinue all or part of Nailumi when reasonably necessary for operation, security, legal compliance, or product changes. We do not guarantee uninterrupted or error-free availability.

We may suspend or terminate access when we reasonably believe these Terms have been violated, the service is being abused, or continued access creates legal, security, or operational risk.

10. Disclaimer of Warranties

To the maximum extent permitted by law, Nailumi is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, 9VIL LLC and its officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or damages arising from reliance on an AI-generated preview, a salon result, or your inability to access Nailumi.

These limitations do not apply where liability cannot be limited under applicable law.

12. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where 9VIL LLC is registered, without regard to conflict-of-law principles. Any mandatory consumer protections available in your place of residence remain unaffected.

13. Changes to These Terms

We may update these Terms as Nailumi or applicable requirements change. Updated Terms will be posted here with a revised effective date. Continued use after updated Terms take effect means you accept them to the extent permitted by law.
